Dear Mr
Morris
I refer to your letters to me via my lawyer dated 9 August July 07 and 2 October 07 respectively.
To confirm that I have never received the 9 August letter from you and therefore must have gone missing in the system somewhere.
I am pleased to hear however that you did in fact reply on behalf of Crown Minerals.
Your reply however implies, as the Associate Minister of Energy’s letters do, that I am seeking reparations for solely economic loss.
For the record, as per my web pages at www.2dvd.biz/greenstone.html
and paragraph 3 of my letter dated 31 July 07 to Mr R. Smillie, I have very
clearly stated that I am seeking resolve from the Ministry for not only all statutory costs and
compounding interest due to me but also personal and financial damages the
Ministry has caused me by refusing to acknowledge my statutory rights and
intentionally expropriating those legal rights over a period of seventeen
years.
Notwithstanding the fact the
Associate Minister and yourself, as a legal representative of the Ministry, are
blatantly continuing to do so to this day, irrespective of your alleged legal
obligations.
In effect,
you are confirming that both Parliament and the Governor General intentionally
passed the Ngai Tahu (Pounamu Vesting) Bill into law without due legal regard to
the existing statutory law and the relevant statutory contracts and rights
accorded to applicants.
Under the
Official Information Act and the rights accorded to me under the relevant mining
Acts of my mining privileges and applications, I herein respectfully request that your
office advise me in writing of the Ministry of Economic Developments legal
obligations and your perceived status of (existing) privileges and applications
in my case as at 2007.
If the
Ministry feel they have no legal obligations or I have no rights, then please
advise the reasons why accordingly.
Thank you
for any assistance you can give me on this matter.
Yours sincerely
Kenn Landaus
