Now that the Genharrow Holdings litigation seems to have been resolved, I would like to clarify a few further issues in respect to a letter from Hon. Harry Duynhoven, Associate Minister of Energy. to various newspapers criticising my alleged statements regarding greenstone ‘claims’.
Hon. Duynhoven seemed concerned about the wording of “unresolved claims”.
Perhaps the article in question was a little unclear in respect to the meaning of claims and perhaps the reporters may have used more correctly, ‘Prospecting License Application’, to keep the Minister and Te Runanga o Ngai Tahu better informed.
The claims I do speak out about are the allegations I have put to the Ministry over the last fourteen years. Some of which relate to this prospecting application that by no means have been legally resolved, irrespective of the Secretary of Commerce declining that application in 1998, 9 years after I made official application.
The application was only for a 3year term. During this time many other mining licenses were granted for up to 42 years yet the Ministry withheld mine until after the enactment of the Ngai Tahu (Pounamu Vesting) Act 1997.
This application was over the majority source of the south-western jade fields, worth today in the billions of dollars.
I allege the Crown have failed in their statutory responsibilities during the processing of this application and until they can prove the legitimacy of their actions in respect to the evidence I have provided against them, then I must consider that this application remains to have a transitional effect with the Ngai Tahu (Pounamu Vesting) Act 1997, irrespective of the Crown Minerals Amendment Act 2003, until the matter is satisfactorily resolved one way or another.
The Crown also allegedly vested the Greenstone Valley over to Ngai Tahu while my application was still current over the land in the region.
