NOTICE OF ALLEGED BREACH OF THE OFFICIAL
INFORMATION ACT 1982
In my letter to you dated 20 August 1997, I
specifically requested that you provide information to explain how the Crown
can legitimately vest Crown owned minerals to private parties when those
minerals are already incumbent to existing applicants under the mining Act's
and Statutory Regimes.
In your letter of reply dated 17 September 1997
you allegedly evaded this specific request by stating that both a moratorium
and the Ngai Tahu (Pounamu Vesting) Bill prohibited the Crown from granting any
further licences or permits for pounamu.
My request did not pertain to a moratorium of no
statutory relevance or a Bill which at the time was not passed into law. I
requested statutory information directly relevant to my above mentioned
statement.
To date you have not answered and accordingly I
am asking for the same information eight months later.
It is not necessary that I stipulate the
Official Information Act each time I request information, especially to a
Minister of the Crown who is directly responsible to my affairs.
I therefore allege that you have breached the
Official Information Act 1982 by not supplying information or evidence of that
information I requested, within 20 working day's from receipt of my request.
This matter will now be put in the hands of my
solicitor along with the alleged defamation case.
